Tier Ⅳ Inc. (Location: c/o Nagoya University Open Innovation Center, 1-3, Mei-eki 1-CHOME, Nakamura-Ward, Nagoya-City, Aichi Prefecture, Japan, hereinafter referred to as “Company”), believes that proper handling and protection of User’s personal information collected by us is an important social responsibility in developing software and platform and expanding other associated business activities. Based on this basic Privacy Policy on protection of personal information (hereinafter referred to as "Privacy Policy"), Company will properly handle and protect personal information acquired by Company.

1. Definition of Personal Information and Personal data

(1) The term “Personal Information” as used in this Privacy Policy means information about a living individual falling under any of the following categories:
(a) Information that includes name, date of birth, telephone number, e-mail address or any other description that may enable identification of specific individuals;
(b) Information that by itself does not enable identification of specific individuals, but that can be easily collated with other information and thereby enable identification of specific individuals; or
(c) Information that includes individual identification code as defined under Article 2, Paragraph 2 of the Act on the Protection of Personal Information (“Personal Information Protection Act").

(2) The term “Personal data” as used in this Privacy Policy shall mean a Personal Information Database etc. defined under the Article 2, Paragraph 4 of the Personal Information Protection Act.

2. Acquisition and Purpose of Use of Personal Information

(1)We will acquire the User’s Personal Information legitimately and appropriately, and will use the same within the scope necessary for achieving the following purposes:

(a) For the purpose of providing various services based on Tier IV account;
(b) For the purpose of identification and verification of Users to provide various services based on the Tier IV account, etc. coincidentally;
(c) For the purpose of answering to after service, inquiries and complaints accompanying (a) or (b) above; and
(d) For the purpose of providing Personal Information or Personal Data to third parties in order to achieve any of the purposes mentioned under (a) through (b) above.

(2)In the event that User’s Personal Information is required to be used for a purpose other than the purposes set forth in the preceding paragraph, with the exception of the following cases, User’s Personal Information may be used on obtaining User’s prior consent by informing the User of the purposes of use of User’s Personal Information:

(a) Where it is necessary to protect the life, body or property of a person, and it is difficult to obtain User’s consent;
(b) Where it is specially necessary for the improvement of public hygiene or fostering healthy children, and it is difficult to obtain User’s consent;
(c) Where it is necessary to cooperate with a government organization, local authority or a person authorized by such body so that legally prescribed tasks can be executed, and where there is concern that obtaining User’s consent may hinder execution of the particular task; or
(d) Where required by laws and regulations.

(3)Excluding the cases set forth in Article 17, Paragraph 2 of the Personal Information Protection Act, the Company will not acquire special care-required personal information (Article 2, Paragraph 3 of the Personal Information Protection Act) without obtaining the User’s prior consent.

3. Provision of Personal Data to Third Parties

(1)In the following cases below, the Company may provide Personal Data to third parties, including subcontractor of the Company (excluding third parties in foreign countries; hereinafter, the same applies in this paragraph) and such other third party:

(a) where User’s prior consent is given;
(b) where the disclosure of Personal Information is requested from the court, the public prosecutor's office, police office, tax office, bar association, or authority pursuant to the above authority;
(c) where the disclosure is made to a financial institution, a credit card company, a settlement agent or other payment settlement service provider or a business operator who settle the fee to be paid to the Company;
(d) where the disclosure is made to the person succeeding the business at the time of the succession of the business due to merger, business transfer or other reason;
(e) where the disclosure is permitted by the Personal Information Protection Act or other laws and regulations; and
(f) where separately determined for each service of our company.

(2)Notwithstanding that none of the provisions in the preceding paragraph apply, the Company may provide Personal Data (excluding special care-required personal information; hereinafter, the same applies in this paragraph) to third parties (excluding third parties in foreign countries; hereinafter, the same applies in this paragraph) within the following scope, on notifying the Personal Information Protection Commission of such provision:

(a) Items of Personal Data that may be provided to third parties in accordance with this paragraph; All User’s Personal Information, excluding Personal Information that the User have specifically requested not to be provided.
(b) Methods of providing Personal Data to third parties in accordance with this paragraph; Paper, electronic data transfer, by delivery through external recording medium, or by server access; and
(c) Methods of requesting cessation of the provision of Personal Data in accordance with this paragraph; Where the User request the Company to cease providing Personal Data to third parties in accordance with this paragraph, the Company will cease providing the Personal Data that the User have identified without delay and in accordance with laws and regulations. (3)The Company may provide Personal Data to third parties in foreign countries in any of the following cases:

(a) Where the User’s prior consent is given to provide Personal Data to third parties in foreign countries;
(b) Concerning the handling of Personal Data, where Personal Data is provided to third parties in foreign countries that have implemented measures in accordance with the provisions of Chapter 4, Section 1 of the Personal Information Protection Act by appropriate reasonable measures, and with whom the Company has ensured implementation of such measures;
(c) Where the User cannot be individually identified; or
(d) Where any of the cases provided in Section 2.(2)(a) to (b).

4. Joint use

The Company may use the User’s Personal Data jointly within the scope provided below;

(d) For the purpose of providing Personal Information or Personal Data to third parties in order to achieve any of the purposes mentioned under (a) through (b) above.

5. Management of User’s Personal Information

(1) The Company will appropriately manage to implement necessary and appropriate organizational, personal, technical and physical safety control measures in order to prevent unauthorized access to Personal Information and loss, falsification and leakage of Personal Information.

(2) The Company will conclude subcontracts with our subcontractors that include non-disclosure provisions. and will make efforts to have our subcontractors appropriately handle and secure the User’s Personal Information, and will prevent the leakage, re-provision or disclosure to third parties, or use of Personal Information beyond the scope of purposes listed in Section 2. (1) above.

6. Disclosure, Correction, Addition, Deletion, Cessation of Use, Removal or Cessation of Provision of the User’s Personal Data to Third Parties

(1)Where the User would like to disclose, correct, add to, delete, have the Company cease the use of, remove or have the Company cease the provision of Personal Data, directly contact “Tier IV Personal Information Inquiry Center” described below.

(2)Excluding special procedures stipulated under laws or regulations from the perspective of preventing the leakage of Personal Information, and maintaining the accuracy and security thereof, the Company will conduct any necessary investigation without delay. Only where it is confirmed that the request relates to the User’s Personal Data will the Company disclose, correct, add to, delete, cease use of, removal or cease provision of Personal Data to third parties in accordance with laws and regulations.

7. Disclaimer

On using the Company’s website, and registering the User’s ID and password, please manage the same extremely carefully. The Company bears no responsibility for any damage that the User may incur arising from any unauthorized use thereof. If the User have registered falsified facts or information of another person, we may suspend use of the User’s ID and password.

8. Notification of Changes to this Basic Policy

Where required, this Basic Policy may be amended. Since the Company cannot contact the User on every occasion, please refer to the Company's website for the latest version of this Basic Policy.

9. Cookies

(1) The Company uses cookies on its website. Cookies make use of the website more convenient when the User access it. Cookies identify the information systems of the User’s computer; however, the User cannot be identified as long as the User do not input information that can identify the User. By changing the User’s browser's settings, cookies may be invalidated; however, by doing so, all or parts of the services offered on the website may not be able to be used. The User can delete all cookies stored on the User’s device and set the User’s browser to prevent the storage of cookies. This Special Clause for Recording Public Road Image Data (hereinafter referred to as “Special Clause”) is the provision of the special agreement clause for Tier IV Inc., (Location: c/o Nagoya University Open Innovation Center, 1-3, Mei-eki 1-CHOME, Nakamura-Ward, Nagoya-City, Aichi Prefecture, Japan, hereinafter referred to as “Company”) to conduct a business related to recording and acquiring image data on public roads (hereinafter referred to as the "Project" in this Special Clause), in compliance with the Company's Privacy Policy. When the Company acquire Personal Information when carrying out this Project, the Company will handle appropriately and strive to protect these Personal Information.

1. Outline of this Project

In this Project, the Company set up a camera on the outside or the inside of a road transport vehicle (defined in Article 2, paragraph 1 of the Road Transport Vehicle Act) managed by the Company or a third party affiliated with the Company, and record the public road and acquire and analyze the image data of the public road (hereinafter referred to as "this Public image data") . Although this Project is not intended to acquire information that identifying individuals and personal privacy information of individuals reflected in the Public image data, there is a possibility that it becomes Personal Information that can identify each individual who is in the public road in the case where the public appearance image data includes personal appearance, the appearance of the residence or the name plate etc.

2. Types of Personal Information to be acquired

Person's appearance, appearance of the building, nameplate showing name of individual, individual owned road transportation vehicle (including its license plate) information that can identify other individuals.

3. Purpose of using Personal Information

To acquire and analyze 3D space data on automatic operation system business owned by the Company and to develop and provide automatic operation system business.

4. Scope of the entities that will use information jointly

The Company and our group companies and businesses jointly cooperating in this Project. In addition, for each business entity to which the Company affiliated, it is limited to business operators who present them separately on our website.
